1. Acceptance of Terms
By creating a SnapsX account, connecting a Facebook Page or Instagram Business Account, or otherwise accessing the SnapsX service (the “Service”), you agree to be bound by these Terms of Service (the “Terms”) and by our Privacy Policy. If you do not agree, do not use the Service.
2. Description of Service
SnapsX is a software-as-a-service tool that automates keyword-based replies on Facebook Pages and Instagram Business accounts. You connect a platform account, configure keyword-trigger rules and response templates, and the Service automatically posts comments or sends Direct Messages on your behalf when an inbound event matches one of your rules. The Service applies platform safety mechanisms — a randomized jitter delay (15-90 seconds) before each reply, per-account Meta Graph API rate limiting, idempotent deduplication of duplicate webhook deliveries, and Meta's 7-day Facebook / 24-hour Instagram DM messaging window — designed to keep your account within Meta's acceptable-use thresholds.
3. Eligibility
You must be at least 16 years old to use the Service. The Service is intended for business use: managing your own page or your employer's page in a commercial capacity. Personal use is permitted but unsupported.
4. Your Account
You are responsible for maintaining the confidentiality of your SnapsX credentials, your Clerk-managed identity, and the credentials for any platform account you connect. You are responsible for all activity that occurs under your account, including activity initiated by team members to whom you grant access. Notify [email protected] immediately if you believe your account has been compromised.
5. Acceptable Use
You agree not to use the Service to:
- Send spam, unsolicited bulk content, or content that violates Meta Platform Policies.
- Harass, threaten, defame, or impersonate any person or entity.
- Distribute malware, phishing links, or content that attempts to deceive recipients into disclosing credentials or financial information.
- Circumvent the platform safety mechanisms (jitter delay, Meta Graph API rate limits, message-window enforcement, idempotent deduplication) that the Service applies. The Service honors Meta's published rate and content limits; you may not request behavior that exceeds what Meta permits.
- Reverse-engineer, decompile, or attempt to extract the source code of the Service except to the extent permitted by mandatory law.
- Resell or sublicense the Service without our written consent.
We may suspend or terminate access for violation of these Acceptable Use rules with or without prior notice.
6. Connected Platforms
The Service operates on top of Meta's Graph API. By connecting a Facebook Page or Instagram Business Account, you grant us the OAuth scopes required to read events and post replies on your behalf. You warrant that you are authorized to grant those scopes and that your use of the Service complies with the Meta Platform Terms, the Meta Developer Policies, and the Instagram Platform Policy (where applicable). If Meta revokes our access or your access for any reason, the Service may stop functioning for your account; we are not liable for resulting outages.
7. Subscription & Billing
The Service is currently free during the alpha period. We reserve the right to introduce paid plans in the future; if we do, we will give you at least 30 days' notice before billing begins, and continued use of the Service after that notice constitutes acceptance of the new pricing terms. No payment processing is currently active.
8. Termination
You may cancel your account at any time by deleting it through the in-app flow at /data-deletion or by emailing [email protected]. We may suspend or terminate your account for violation of these Terms, for violation of Meta Platform Policies, in response to a lawful order, or if continued operation poses a risk to the Service or other users. On termination, your data is deleted per the retention schedule described in our Privacy Policy.
9. Disclaimer of Warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT REPLIES WILL BE DELIVERED WITHIN ANY SPECIFIC TIMEFRAME.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL SNAPSX, ITS AFFILIATES, OR ITS LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED EURO (€100).
11. Indemnification
You agree to indemnify, defend, and hold harmless SnapsX and its affiliates from any third-party claims arising out of (a) your violation of these Terms, (b) your violation of any Meta Platform Policy or applicable law, or (c) your content posted via the Service.
12. Changes to Terms
We may update these Terms from time to time. We will update the “Last updated” date at the top of this page when we do. Material changes will be emailed to active users at the address on file at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
13. Governing Law
These Terms are governed by the laws of Germany (placeholder pending entity registration; if SnapsX's operating entity is registered elsewhere by the time you read this, the registered jurisdiction controls). Any dispute arising out of or related to these Terms or the Service shall be brought exclusively in the courts of the registered jurisdiction, except that either party may seek injunctive relief in any court of competent jurisdiction.
